New York State Voluntary Disclosure and Compliance Program

New York State created the Voluntary Disclosure program to encourage Taxpayers who had not filed or paid their taxes to voluntarily come forward and file and pay what they owe. 


Under the Voluntary Disclosure Program, eligible Taxpayers can avoid potentially steep monetary penalties and possible criminal charges by:

  • disclosing what tax types and years they owe,
  • filing those returns and paying those taxes, and
  • entering into an agreement to stay compliant with the tax laws in the future.

Many  Taxpayers will be eligible for a limited look back period of just three  years. Others will get look back period of six years, meaning they will  only have to prepare, file and pay six years’ worth of taxes.  


The program covers all types of tax  administered by the New York State Department of Taxation and Finance including income, corporate, payroll and sales taxes.

New York State Offers in Compromise

Let Wynne Law, P.C. assist you with filing a NYS Offer in Compromise.


Like the IRS, NYS also has an Offer in Compromise program that allows eligible Taxpayers to settle their debts for less than the full amount they owe if the Taxpayers are  unable to  pay their full tax liability or if paying their full  liability will result in hardship.  NYS will consider their unique set of facts and  circumstances including their ability to pay, income, expenses and equity  in assets.


Unlike the IRS, no payment is due to NYS until after the offer is accepted.  And then the offer amount may be paid over time.

New York State Installment Payment Agreements

Let Wynne Law, P.C. assist you with setting up a New York State Installment Payment Agreement. 


If a taxpayer is unable pay their balance due in a lump sum, NYS may allow them to pay off their balance in monthly installments.  Entering into an Installment Payment Agreement with New York State will prevent further collection actions such as bank levies.  However, interest and penalties will continue to accrue until the balance is paid in full.
